If missing, ask the user for clarification before starting the knockout workflow. * Mark name * Nice class(es) * Registration Office(s) * Should web search be performed: Yes or No ? ## Search strategy Each search uses one `match` value: | match value | Meaning | | ------------- | ------------------------------------------------ | | `exact` | full trademark matches the mark pattern | | `word` | a word in the trademark matches the mark pattern | | `contains` | trademark contains the mark pattern anywhere | | `begins with` | a word begins with the mark pattern | | `ends with` | a word ends with the mark pattern | ### Searches (run in order until 35 unique IDs collected) 1. Exact mark | match: exact phonetics: off plurals: off cross-refs: off 2. Same word, expanded | match: word phonetics: on plurals: on cross-refs: on 3. Contains | match: contains phonetics: off plurals: off cross-refs: off 4. Contains, expanded | match: contains phonetics: on plurals: on cross-refs: on 5. Exact mark, all classes | match: exact phonetics: off plurals: off cross-refs: off classes: all ### Applied to every search activeOnly: true japanesePhonetics: false centralEuropeanPhonetics: false Classes: * a search with no classes set -> use the user's classes. For multiclass queries, use comma-separated class values within a single field entry. For example, a search in class 3 and class 4 should be passed as one entry with value `"3, 4"`. * a search with classes: all -> omit the class field (searches across all classes) Offices: * always add WO with limitWOresultsToDesignated: true * if the requested office is in the EU -> also add EM ### Match -> query field operator is always EQUALS; never use CONTAINS / BEGINS_WITH / ENDS_WITH | match value | query field | value | | ----------- | ----------------------------------- | ---------- | | exact | field EXACT_WORD_MARK_SPECIFICATION | `<mark>` | | word | field WORD_MARK_SPECIFICATION | `<mark>` | | contains | field WORD_MARK_SPECIFICATION | `*<mark>*` | | begins with | field WORD_MARK_SPECIFICATION | `<mark>*` | | ends with | field WORD_MARK_SPECIFICATION | `*<mark>` | Wildcards: keep any already present in `<value>`; don't duplicate `*` when adding it. ``` *Llama*h + contains -> *Llama*h* ``` ### Results Using IPOne trademark-search tool: collect IDs in search order, then de-duplicate (keep first occurrence). Stop once 35 unique IDs are reached, and skip any remaining searches. ## Knockout Search Workflow Start ### Initialize * This workflow can only be done if IPOne trademarks tools are connected. If not, stop and explain to the user. * All your output should be in the same language as the one used by the user, including elements from the report template. * Check that you have all the required parameters required from the user. If not, ask the user. After finishing this step, surface this message to the user: ``` **Planned Steps** 1. Get search criteria 2. Conduct trademark searches ['& web search' if requested] 3. Analyze risk 4. Draft report ``` ### 1. Collect trademark data * Get trademark IDs following the search strategy. * Get the content of these trademarks. * Review the trademarks content and select the five most relevant trademarks, prioritizing active marks whose names are closest to the searched name. * Retrieve full-text URLs for the Top 5 ### 2. Web search (optional) * Search the given mark name on the web. The search query should be exactly the mark name. ### 3. Analyze risk * Assess risk level by evaluating: * Exact matches vs. similar/phonetic matches in the same class * Results in related classes that could affect the mark * Geographic concentration of conflicting marks * Active vs. inactive registrations * Commercial vs. dormant online use * Strength and reputation of conflicting marks (if data available) * Grace period or potentially vulnerable to cancellation (over 5 years old, no active use, etc.) * Identify key conflicts: flag the most material trademark records, and online uses that create practical risk. * Evaluate jurisdictional impact: assess which jurisdictions present the highest risk relative to the user's commercial plans. ### 4. Write report * Based on the results from searches and analysis, write the knockout search report. * Include the web search section only if the web search was requested by the user. Otherwise skip the section fully. * Strictly use the template below.
